  1. Freeware License Agreement
  2.  
  3. Please read this agreement carefully before using Ziepod. By installing, copying, 
  4. or otherwise using the Software or any Software Updates, Customer agrees to be 
  5. bound by the terms of this Agreement. If Customer does not agree to the terms 
  6. of this Agreement, do not install, copy, or use the Software, including all 
  7. Software Updates that Customer received as part of the Software (each, an 
  8. "Update").

  10. 1. Copyright 
  11.     
  12. All title and copyrights in and to the Software (including but not limited to 
  13. any software components, product documentation and associated media, sample 
  14. files, extension files, tools and utilities, miscellaneous technical 
  15. information, collectively referred to herein as the "Software"), and any copies 
  16. of the Software, are solely owned by Arda CELEBI.

  18. 2. Grant of License 
  19.  
  20. a. Arda CELEBI grants Customer an unlimited license to use the Ziepod. The install 
  21. packages can be freely redistributed and used both in commercial and non-commercial 
  22. purpose without modification, provided that: Redistributions in binary form must 
  23. reproduce the exact original copyright notice (Copyright ⌐ 2005 Arda CELEBI. 
  24. All rights reserved.)

  26. b. Use within the scope of this license is free of charge and no royalty or licensing 
  27. fees shall be payable by you. Use beyond the scope of this license shall constitute 
  28. copyright infringement.

  30. 3. Termination 
  31.  
  32. Without prejudice to any other rights, Arda CELEBI may terminate this 
  33. Agreement if Customer fails to comply with the terms and conditions of this 
  34. Agreement. In such event, Customer must destroy all copies of the Software in 
  35. any form and all of its component parts.

  37. 4. Disclaimer of Warranty 
  38.  
  39. a. NO WARRANTIES. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. 
  40. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Arda CELEBI DISCLAIMS 
  41. ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED 
  42. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY 
  43. WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO THE SOFTWARE. THIS LIMITED WARRANTY 
  44. GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM 
  45. STATE/JURISDICTION TO STATE/JURISDICTION.

  47. b. NO LIABILITY FOR DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 
  48. IN NO EVENT SHALL Arda CELEBI BE LIABLE FOR ANY DAMAGES WHATSOEVER 
  49. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS 
  50. INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING 
  51. OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF Arda CELEBI HAS 
  52. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME 
  53. STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR 
  54. CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  56. c. Arda CELEBI SHALL BE RELIEVED OF ANY AND ALL OBLIGATIONS WITH RESPECT TO 
  57. THIS SECTION FOR ANY PORTIONS OF THE SOFTWARE THAT ARE REVISED, CHANGED, 
  58. MODIFIED, OR MAINTAINED BY ANYONE OTHER THAN Arda CELEBI 
  59.

  61. CUSTOMER ACKNOWLEDGES THAT CUSTOMER HAS READ THIS AGREEMENT, UNDERSTAND IT AND 
  62. AGREES TO BE BOUND BY ITS TERMS AND CONDITIONS. CUSTOMER FURTHER AGREES THAT IT 
  63. IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN CUSTOMER AND 
  64. Arda CELEBI. WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR 
  65. WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN CUSTOMER AND Arda CELEBI. 
  66. RELATING TO THE SOFTWARE. This Agreement may not be modified except by a writing 
  67. signed by a duly authorized representative of Arda CELEBI
